Ags get apology from CS police

The College Station Police Department apologized Thursday for inconveniencing and embarrassing two Texas A&M students after arresting them last weekend on charges that were later dismissed.

The department said that it would reimburse Chad Kuboviak, 25, and Russell Hall, 22, for any expenses related to their Nov. 7 arrests and that it would remove from the men's records the misdemeanor charges of racing on a highway.

Kuboviak and Hall were manning checkpoints for a rally sponsored by the Texas A&M Sports Car Club when they were stopped by police.

Officers said the two men were loading checkpoint signs, notebooks and stopwatches into their cars, but police said they never witnessed anyone racing.

The charges were dismissed Wednesday after an internal review determined that "officers had misinterpreted the statute and the elements of the offense were not met," the department said in a statement.

"The College Station Police Department regrets any inconvenience or embarrassment this incident may have caused these young men and their families," the statement says.

Brazos County Attorney Rod Anderson, whose office prosecutes most misdemeanor cases, said he wasn't surprised that the Police Department asked him not to pursue the case.

"I was expecting it to come through," he said.

The charges were Class B misdemeanors punishable by up to 180 days in jail and $2,000 fines.

Officers said department representatives would meet with club members to learn more about the group's monthly rallies and to discuss public safety concerns.

Road rallies are timed driving contests held on public roads at legal speeds in which competitors are expected to abide by local laws. The objective is to come as close as possible to the optimal travel time between checkpoints hidden along the route without getting lost while following coded instructions, according to the club's Web site.

Kuboviak and Hall did not respond Thursday night to messages left for them.

Comment Title:
Edgar Feldman was a local (College Station) boy and went through the ranks to be chief. He had the ears and cooperation of College Station resulting in very effective law enforcement. I think Chief Morrow of Bryan is using some of the same techniques used by Feldman, getting the trust of residents and getting residents involved.

One incorporated city cannot annex another incorporated city. The drug bust mentioned by James was coming from Houston and destined for College Station per the police report.

James the drugs are coming From Bryan to Houston. The only resident from this part of the state arrested was from Bryan.

I personally know Chief Feldmen, I took a class from him a few years ago. He was an excellent Chief, since he retired College Station P.D, they have gone crazy, Can't College Station P.D have him as an advisory personnal or something, cause I don't know what College Station is doing? We got crazy cops

Let the CSPD officers spend some time with some real cops; Bryan PD. They will learn how to make a proper arrest.

Comment Title: Crime Awareness
Let's not kid ourselves here, College Station is well aware of crime. Our autos are constantly being broken into, our elderly are being mugged in front of major businesses, suspects are trying to take batons from our officers, drug shipments from Houston are being intercepted before they can reach their destination in our city. I could go on and on. The solution is as inferred, put the police where we need them.

CSPD has some real issues on writing tickets and Traffic enforcement. Jay walking, Red light photos cameras etc. The other day a motorcycle officers pulled a older man over on a bicycle and was writing him a ticket near the Mall in a resident area. You people in CS need to get it together and learn about real crime. If not you could be annexed by Bryan one day.

After review, it seems whatever these young men were charged with is not eligible for citation instead of arrest. I sure hope these men accept the apologies and expense reimbursement and call it even. While I'm not sure a suit for false arrest could be won, it could sure tie up the county courts and College Station City Attorney costing both the county and city of College Station taxpayer dollars.

Officers said department representatives would meet with club members to learn more about the group's monthly rallies and to discuss public safety concerns. *** This club has been around since 1968 holding monthly events and CSPD is only now getting to this. I can assure you Chief Feldman was aware of this club. Sounds like face saving to me.
