Boyett is admonished

Precinct 3 Justice of the Peace George Boyett recently received a public admonishment from the State Commission on Judicial Conduct.

Boyett -- who has been a JP for almost 20 years -- was rebuked after ordering a Texas A&M student who had run him off the road to show up in his courtroom the next day.

Once she did, he admonished her even though the case wasn't pending before him, and he directed his bailiff to issue a citation to the student after "becoming annoyed [by] the argumentative behavior of the student's father" in court.

Boyett declined to comment Thursday.

Judge Sid Harle, chairman of the Austin-based commission, wrote in a document signed Dec. 18 that Boyett had violated three parts of the Texas Code of Judicial Conduct:

* He didn't act in a manner that promoted public confidence in the judiciary.

* He used the prestige of his office to advance his private interests.

* He did not act in a "patient, dignified and courteous" manner toward those in his courtroom.

The incident was outlined in the commission's admonishment. The document states that while driving in College Station a year ago Saturday, Boyett was forced off the road when a driver made an improper lane change. No damage was done to Boyett's car, but he decided to follow the driver to her apartment complex to have "a discussion with the student, in his role as a private citizen, about her unsafe driving," according to the report.

Their exchange ended with Boyett handing her a business card and requesting that she meet him in his courtroom the following day to continue the discussion.

When the student and her father arrived, the parent argued with the judge and questioned his authority to order the daughter to his courtroom, according to the report. Boyett grew annoyed with the father's behavior and had a citation issued to the student, though the improper lane change happened in another judge's precinct.

The admonishment marks the third for Boyett.

The other two both were issued in June 2002. One was for speaking to a game warden in a derogatory manner. The other was for waiting 28 days before signing a death certificate for a funeral home after his staff told him the director was being "rude, demanding and unreasonable," according to commission documents.

In each of those cases, Boyett was found by the commission to have allowed his staff to improperly influence his conduct and judgment.

The commission receives more than 1,000 complaints a year, but not many go far in the process, officials with the commission said.

"At least half of those get dismissed early on in the investigation," said Seana Willing, executive director of the State Commission on Judicial Conduct. "From there, only 10 to 20 percent of them actually result in disciplinary action."

The following actions can be taken by the board: It can do nothing, or it can issue a public or private admonition, warning or reprimand. An admonition is the lowest level of disciplinary action that can be taken, officials said.

Though no criteria are set to determine the level of punishment, there are guidelines in place, Willing said.

"Typically, what the commission does is look at cases they've voted on in the past," she said. "If the facts are similar, they want to be consistent, so they base it on how they've handled those other cases in the past."

My dad called me the other day with the news that Judge Boyett had screwed up once again. What a fool!!! College Station keeps electing this guy. That’s the sad part of the story. Well, my reasons for disliking him are my own. All we can do is hope that he will one day retire, and make his living off his rental properties.

This behavior is frowned on in Brazos County as a whole, i.e. Rick Davis. Apparently only in College Station does it meet with voter approval.

Comment Title: Courtroom
"Justice has nothing to do with what goes on in a courtroom; Justice is what comes out of a courtroom." Clarence Darrow Usually people who throw the most mud and cry when someone catches them doing wrong are the ones who always depend one others to pull their fat out of the fire. Often a good "Butt" chewing is what they really need. If their life is then changed for the better, then justice was served. If their life was not changed, they will be back in court.

Comment Title: Pathetic Human
Lets see where should I start...what could I say about judge boyett that hasnt already been said about afghanistan... I liken boyett to the spawn of satin. If ever there was a creature that deserves to be put in a crate and dumped in the mouth of a steaming volcano, he is it. The man is a train wreck, who doesnt even have the basic common sense and clarity of mind to officiate a game of checkers. He has the arguing maturity of a 5 year old who interupts and uses phrases such as "Because I said so" and "I can do what I want"....which is precisely what he does. And apparently what he wants, is to be a pompus jackass with the temper of a NHL hockey player, and the self control and loud mouth of a drunk teen at Mardi Gras. His also has his staff whipped to do his bidding like the Oompa Loompas of Willy Wonka. They have a strategy of telling you that all your paperwork is correct and done when it isnt, so that you can go to court and boyett can maximize the fine because ur paperwork wasnt completed for court. Of course before he does that, he makes it his personal vendeta to flap is gums about how pathetic you are and how dumb you were to even step forth into his kingdom to try to contest a ticket. If ever there was a reason to bring back public stoning, he is it. I cringe to even hear his name, yet reading about his most recent news fame made today a day of celebration. If I was the girls dad I would have gone ballistic on this jerk. boyett's future should follow a few simple steps. 1. Open lips 2. Apply crazy glue 3. Close lips 4. Slam fist into face 5. Repeat spets 4-5 If the state really needs money enough to have a judge this bad, they should sell boyett toilet paper with his cynical face on every sheet. That way everyday he would be wiped where anyone who has ever met him knows he belongs.

I was in Boyette's court years ago because I had a legitimate ticket for not having a valid inspection sticker. Desite the fact that I was courteous and respectful, the judge felt it necessary to try to belittle me and even indicated that I could be put in jail for this offense. He seemed to take delite in pointing out any shortcomings of all who were in his court that day. Some posters have hinted here that Judge Boyette has a severe drinking problem. I don't have personal information to support that but I do know that his attitude leaves much to be desired.

A long time ago I had to go in front of him. There was a line of about 6-7 hispanics and then me, the only white guy. He asked each of us why we were there, and when he got to me and I said DWI, he laughed. I didn't think it was funny. It was a Saturday morning and his nose was redder than Rudolfs.

Comment Title: Former Boyett Victim
Several years ago I appeared before Boyett for a speeding ticket. I was 17. I was very much in the wrong and deserved a ticket. However, despite being polite, clothed appropriately for court, having no other offenses, demonstrated I was a good student, had no prior tickets on my record and held a part time job, I was given community service, a large fine, had to pay the ticket AND was put on probation. I would've been able to accept all of that but in addition to this, Boyett was incredibly rude to every person in the court...including adults who where there for routine traffic citations. I remember him laughing loudly with his bailiff in regards to a man who was also appearing before him. I also watched Boyett once ask for a manager, at an establishment I was working at as a teen, and point out a dip in the sidewalk in a rude and demeaning fashion...as if the manager had put the dip there. I haven't lived in his precint for years and unfortunately have only had the honor of voting against him once but this man should've been voted off the bench years ago!

Comment Title: Every one knows
He gave me hell when I was a teen and told my mom and dad to stay out because we would regret it. He did this to many people and I am surprised this didn't happen sooner. I missed school because I was sick for 4 days and got punished buy removal of license and didn't get it back for a year. I know it was wrong what he did but we didn't know who to tell or complain. He looked threatening.

Comment Title: What about the criinal sanctions
It is a cxriminal offense to use a public office to serve Boyett's own personal agenda like so many officials in this town do.Why isn't he arrested. Further, the failing of following appropiate judicial notice should have been enough to remove him once and for all.

Comment Title: Endangered Driver
Just yesterday (Thursday) a soccer mom and wife of a rather prominent local businessman cut me off in front of Kroger in C/S traveling South on Texas Ave to turn left at Southwest Parkway across three lanes from far right to far left causing me to have to brake hard. I was in the center lane and there was absolutely no traffic behind me. The light was changing to 'red' so a glance in the mirror would have told her, just slowing down a little would have given her free access to crossing without endangering me. This case as well as the student who cut off the judge could have been avoided if the driver had of used a little courtesy and following proper driving technique. Maybe, we need a driving course requirement and driving test everytime a person renews his/her drivers license, along with instruction in driver etiquette and courtesy. Just maybe some lives would be saved and less fenders damaged.

Comment Title: Text of Boyett's Previous Admonishments
On June 5, the State Commission on Judicial Conduct issued a public admonition to George Boyett, justice of the peace, Precinct 3, College Station, Bryan County. The commission found that in one matter, a Texas Parks and Wildlife game warden had made a number of inquiries with Boyett’s staff regarding several alcohol-related citations the warden had issued. During a visit to Boyett’s office, Boyett instructed that the warden be escorted into the courtroom. In the courtroom, Boyett persisted in using the term “bird and turtle” when referring to the warden’s work, even though the warden had informed him that the term was insulting. A witness to the meeting stated that Boyett’s temper “flared,” and the witness confirmed the warden’s impression that he was not free to leave the courtroom while the judge was speaking to him. In a second matter, a funeral home director made several efforts to secure a signed death certificate on behalf of a family. Boyett allowed his staff to improperly influence his conduct toward the funeral home director, which caused him to unreasonably and purposefully delay the signing of the death certificate. Boyett’s treatment of the funeral home director was found to be discourteous. Boyett violated Article 5, §1-a(6)A of the Texas Constitution and Canons 2A, 2B, and 3B(4) of the Texas Code of Judicial Conduct. http://www.texasbar.com/PrinterTemplate.cfm?Section=Home&Template=/ContentManagement/ContentDisplay.cfm&ContentID=4459

Judge Boyett becomes annoyed with the student's father and issues a citation to the student? Yes, that makes perfect sense. Very logical. Judge Boyett is obviously a clear thinking man.

Comment Title: Unacceptable
This is the type of behavior that gives public officials a bad reputation in general. I think a 3 strikes and you're out rule should be considered by State Commission on Judicial Conduct. Boyett clearly does not show the restraint necessary for any Judge. Talk about road rage. I am delighted to say I have never met this man. I hope that remains the case.
