Man gets year for giving teens alcohol

A Bryan man pleaded guilty Friday to providing alcohol to three teens killed in a drunken-driving accident in August.

Jimmy Noey, 21, was sentenced to a year in jail.

Carroll Wayne Dicky Jr., 21, was also charged with making alcohol available to a minor, and his case is pending. Dicky was the brother of one of the three teens killed in the crash.

Normangee brothers Gus Benavides, 18, and Dillon Benavides, 16, and 15-year-old Alex Dicky died when their vehicle hit a tree and burst into flames around 4 a.m. on Aug. 3, police said. They had left a party where alcohol was present, police said.

Bryan police and the Texas Alcoholic Beverage Commission arrested Noey and Dicky after a monthlong investigation.

"I can't imagine a more egregious case of furnishing alcohol to a minor," said Assistant District Attorney Cory Crenshaw, who prosecuted the case. "Though I know this prosecution provided little comfort to the families of those poor kids, I hope that the maximum sentence given in this case deters the conduct of others in our community so we can avoid these tragedies in the future."

Making alcohol available to a minor is a misdemeanor, but the District Attorney's Office -- which usually handles felonies -- prosecuted Noey because he had recently been indicted on a felony drug possession charge.

Noey was also ordered to pay a fine of $4,000. He began serving his sentence Friday.

Comment Title:
If this was Mr. Dickey's first time to have trouble with the law, I would have sympathy for him. He was driving with a suspended license AFTER his sister's death, which tells me he has no respect for the law at all. He needs to get the maximum penalty. He has been in trouble over and over and has not changed his ways. Someone who felt remorse for his part in his sister's death would have turned himself in to police right away, sparing his family some of the grief they have had.

First of all: Dicky's case is pending because it hasn't come up yet, he's still being charged. Noey's came up quick because they bundled it with his drug charges. The ADULT (not kid) Noey got the maximum he could get for this crime and that's what he deserves. Dicky deserves the maximum as well. Second, as for taking Dicky from his family, he was estranged from them for years because of his inability to follow the law, his incarceration will just make it more official.

I am not personally familiar with the Dickey or Benavides Family....but just read or hear what is posted for us to hear. The parent's of these children aren't to blame. Sure we raise our kids to the best that we can do...but they have their own minds and when they are out of sight...they are the ones who make their decisions..we as parents can only pray that what they are being taught is enough to make them stop and think before they drink and drive but so often that is not the case. The parents have lost FOREVER children and that is unthinkable and I thank GOD that I have been blessed not to know what that feels like. The time for the crime I agree has to be paid though I know that he will have to live with the loss of his SISTER for the remainder of his days on earth. Why did they furnish a keg to these kids and why did the kids drink to the level they did? Those are questions that all those involved in will have to deal with for eternity. That in itself is a life sentence. By the grace of God no one else got in the path of the vehicle prior to impact. Prayers for all those involved as they take life one day at a time. If only you could turn back the clock................

Why should the Dickey family not get what they deserve. This should let the lil Dickey family member see that he has destroyed their lives and he still need to be punished just like if it was someone else that has done this crime. I'm so tired that when someone works for the law or the justice system others think that they kids shouldnt be punished, well hello they do the crime they do the time and should do the crime in the county that the crime was did in, and not go to another county to do their time...what make them so special. When black kids do crime yall ride their parents day in and out saying the didnt raise their children right...well what do you say about this family? He did the crime he do the time, no matter of your color.

I have no sympathy for the Dicky family or Carroll Dicky. I do regret the loss of life of a child. This is not Carroll's first run in with the law. It is time to slam him hard to let him know society has rules that must be followed for the good of that society. As to the parents, they had no business having children if this is the best they could do in raising them.

Ok I am no relation or personally know anyone involved in this sad sad situation. But asking the the Maximum sentence is horrible. These people that provided the alchol were completely wrong and they now see the ultimate price in their choices. But that must be considered on how the death of A SISTER and just in general how knowing you killed someone or were apart of the reason they died, this will mess them up for life. You are ruining these kids future and it isn't look that great with out the charges. And now the "prosicutor" wanted to make an example give the Dicky family a brake they lost one kid and now you want to take away the other. I just pray that the correct thing is done and not just an example. These are people that made bad choices if they continually make these situation happen to them over and over then by all means hit them with the Max. I just want to say that I am so sorry to the families involve and prayers are being said for you.
