Retrial ends with 90-year term

A Bryan man whose sentence for dealing drugs was overturned by an appellate court was sentenced Tuesday in his retrial to 15 years more than his original punishment.

A Brazos County jury sentenced Larry Allen, 52, to 90 years in prison for one count of possession of a controlled substance with intent to deliver.

It is the fifth time he has been sent to prison and at least the third time on charges of dealing drugs. He has also been convicted of burglary, forgery and possessing a deadly weapon in a penal institution.

Allen was originally convicted in August 2006, but the decision was overturned on appeal because the jury had learned that he intended to appeal a previous conviction. Prosecutors didn't present evidence that the appeal had been disposed of and, therefore, didn't prove that his conviction was final.

Allen faced between 25 and 99 years in prison for the prior conviction because he had prior convictions.

"The sentence in this case shows that the citizens of Brazos County feel very strongly about repeat offenders," said Assistant District Attorney Ray Thomas, who prosecuted the case along with Kara Comte. "This verdict sends a strong message to anyone who continues to break the laws, continues to be sent to prison and continues to be involved in drugs."

The jury in the retrial took less than an hour to reach a verdict.

Allen represented himself in both the original trial and the retrial. He had a court-appointed attorney to offer guidance.

Just because there is a market for a substance, does not mean people should be allowed to sell it. Drugs destroy lives and those that contribute to it (dealers) deserve the most severe penalty. Good job on this one.

I don't care what race they are.. Get a real job and stop that crap.. People are tired of this mess.. Sending a message is a good deal.. I know Larry and he has had every chance to do right..He kept getting into truble.. This is what he wanted.

Just because people want to believe that "race doesn't matter any more" does not make that statement true but, that is not really the point. The question should be what makes selling drugs to people whom want the drugs wrong? Why does selling drugs hold a longer sentence than rape in some cases or even murder. To give a person that is busted selling drugs does not deserve to be in prison for 25 years. Prison is filled with people whom have already learned their lesson. Why spend more money keeping people in prison for selling a product that their customer wants. We should want to spend that money on keeping people whom have raped children,women and men. There are worst crimes that get less time in prison than a drug dealer.

The reasoning behind this is white guys are just all around better people!! Just kidding, of course, but I have no sympathy for either person and do not believe the sentence should be reduced because some one else took a better deal. No two cases are exactly alike and color of skin has less to do with it than you seem to contend.

What DA doesn't tell you is that @same time case pending on white guy who sells meth for a living while on parole; been to prison twice already, first for dealing, second for drug poss. then gets 10 years this time around. Yea it sends a "good message" to BV citizens.
