Arguments surrounding a rare appeal made by the state in the capital murder trial of John Ray Falk Jr. were rescheduled for 10 a.m. Monday in Waco by the 10th Court of Appeals after the district judge sitting in Falk's trial filed a motion to recuse a justice.

Judge Ken Keeling of the 278th district court in Walker County asked that Chief Justice Tom Gray remove himself from hearing arguments on a motion filed late Monday by prosecutors that effectively brought Falk's trial to a halt.
