A Bryan man was charged with driving while intoxicated for the fifth time Sunday, authorities said.
Bryan police said they noticed a vehicle swerving on East 29th Street around 1 a.m. The vehicle stopped at a green light, then drove into the oncoming lane of traffic, authorities said.
Officers said Jimmy Ray Witherspoon, 32, refused to take field sobriety tests. He faces a third-degree felony, which is punishable by two to 10 years in prison.
He was convicted of driving while intoxicated in Brazos County in 2001 and was charged with DWI three times in Franklin County between 2001 and 2004, according to court records.
Witherspoon remained in the Brazos County Jail late Sunday on $12,000 bail.
