A 21-year-old passenger faces a felony charge after Bryan police said he attempted to eat marijuana during a traffic stop.
Bryan resident Daniel Louis Bermudez was jailed on charges of tampering with or fabricating physical evidence. Bermudez and the driver of the vehicle, a 27-year-old Bryan man, also were charged with possession of less than two ounces of marijuana.
An officer said he pulled their car over at 10:50 p.m. Tuesday after he saw the car make a wide right turn from Palasota Drive onto Beck Street. The officer said he smelled marijuana and saw pieces of it on the center console when he approached the vehicle; he also noticed Bermudez in the passenger seat, chewing vigorously, with his cheeks so full they were expanded, court documents state.
Bermudez continued to chew after the officer told him to open his mouth, but then opened his mouth to reveal marijuana, according to a police report. The officer said Bermudez spit out the marijuana he hadn't eaten on his seat after he was arrested.
The driver told police there was a bag of marijuana under a floor mat, according to the report. Police said they found that bag, along with a marijuana blunt when they searched the car.
Tampering with or fabricating physical evidence is a third-degree felony punishable by up to 10 years in prison and a fine up to $10,000. Possession of less than two ounces of marijuana is a Class B misdemeanor punishable by up to 180 days in jail and a fine up to $2,000.
The driver was released from jail Wednesday on $2,000 bail; Bermudez remained behind bars on $10,000 bail.
